How old do I have to be to place a baby for adoption in Georgia?

There is no minimum age requirement for a birth mother to surrender a child for adoption. Georgia always allows any expectant mother to make an adoption plan and place her baby for adoption by signing a surrender under oath, witnessed by a notary and adult witnesses.

What are the rules on open adoptions in Georgia?

Open adoptions in Georgia mean that the birth parents choose the adoptive parents they want to adopt the baby, and the birth parents and adoptive parents know each other. They can agree to whatever amount of contact they want during the pregnancy and after the placement. In open adoptions in Georgia, the adoptive parents are typically at the hospital for the birth, and the birth parents receive picture and letter updates after the placement and can even have visits.
While Georgia adoption law does not require open adoptions, it also does not prohibit them. Georgia birth mothers and adoptive parents are free to make any agreement they wish.
In Georgia adoptions, the parties may agree to a post-adoption contact arrangement. This agreement outlines the terms of communication and visits and becomes legally enforceable once it is in writing and signed by all parties, acknowledging their consent to its terms and conditions. Georgia birth parents have the right to choose the adoptive family they want and the type of relationship they wish to maintain after adoption.

When does the birth mother sign consent in Georgia?

Birth mothers in Georgia who choose adoption cannot sign consent forms until 24 hours after the baby’s birth.

When does a Georgia adoption consent become irrevocable?

Georgia birth parents have a four-day revocation period in which they may change their minds. The four-day revocation period is counted consecutively beginning with the day immediately following the date the surrender of rights is executed; provided, however, that, if the fourth day falls on a Saturday, Sunday, or legal holiday, then the last day on which surrender may be revoked shall be the next day that is not a Saturday, Sunday, or legal holiday. After the four-day period, a surrender of rights cannot be revoked.
Another way of saying this is that Georgia adoption consents become irrevocable four business days after signing.

What are the permissible living expenses a Georgia expectant mother can receive?

In Georgia, adoptive families are permitted to provide certain financial assistance to birth mothers during pregnancy, but all payments must follow specific legal requirements. They may cover or reimburse medical expenses directly related to the pregnancy, the birth mother’s hospitalization for delivery, and medical care for the child.
Additionally, expenses for the birth mother’s counseling and legal services directly connected to the adoption process can be paid. Reasonable living expenses – such as rent, utilities, food, maternity clothing, and accessories – may also be covered; however, these payments must be made through the trust account of a Georgia adoption attorney who is a member in good standing of the State Bar of Georgia.
Direct payments from adoptive families to birth mothers are not allowed. Adoptive parents are also required to submit a detailed accounting to the court documenting all disbursements made in connection with the adoption, including payments for medical care, counseling, legal services, and living expenses.

Can a birth mother pick an out-of-state family?

Yes – a birth mother in Georgia can choose an adoptive family located in another state. This is called an interstate adoption and is very common.
Georgia expectant mothers can choose to work with any adoption agency or adoption attorney they would like, in or out of the state of Georgia. When an adoption involves families across state lines, it becomes subject to the Interstate Compact on the Placement of Children (ICPC).
The ICPC is a legal agreement between all 50 states that establishes uniform procedures for interstate placements of children, including for adoption. The adoption process needs to comply with the adoption laws of both Georgia (the sending state) and the receiving state (where the adoptive family lives).
